SUBJECT 1.1. These general conditions govern the rules for using racing simulators provided by “Simracing Garage” EOOD, EIK 207531807 , with registered office and management address: city of Varna, 23 “Lerin” St., represented by Kiril Stoyanov Stoyanov (hereinafter referred to as ” SimRacing Garage “). 1.2. These general terms and conditions are mandatory for all visitors to the halls of SimRacing Garage and users of the provided racing simulators (hereinafter referred to as “Competitors”). 1.3. Racing simulators are used for training purposes or entertainment and include racing software, a moving platform, seat, pedals, servo amplifier, steering wheel, computer, monitor and may include virtual reality goggles.
REGISTRATION AND PACKAGES 2.1. Racing simulators are used after registration of a user profile by each Racer with three names, current phone number and email. By ticking the box for acceptance of the general terms and conditions upon registration, the Contestant declares that he is familiar with the content of the present general terms and conditions and declares that he accepts them and undertakes to comply with them. 2.2. Competitors pre-pay packages for a specific duration for the respective configuration and use the packages with advance reservation or without reservation according to the available seats in the hall. Each package is individual and can only be used by one Contestant. Prepaid packages can be used within 12 months of their purchase. 2.3. When organizing an event or competition with several participants, it is mandatory to make a reservation in advance and pay a deposit, which is then deducted from the final price. 2.4. Package price paid or deposit is non-refundable. 2.5. SimRacing Garage has the right to request the provision of a damage deposit before using the racing simulator. The value of the deposit shall be refunded to the Contestant after the prepaid package has been used, deducting any compensation due for damages and lost profits, if any. 2.6. Only food and drinks purchased on site may be consumed by Competitors in the hall.
SECURITY 3.1. Competitors undergo training and mandatory preliminary instruction for the correct and safe use of racing simulators. Competitors are obliged to follow the instructions to eliminate the risk of injury and get the most complete experience. 3.2. The minimum height of the Contestants is 125 cm. 3.3. Competitors with existing illnesses (e.g. epilepsy, cardiovascular diseases, spinal problems) are required to inform a SimRacing Garage employee in advance in order to comply with the settings for the safe use of the racing simulator. 3.4. If a competitor experiences discomfort while using the racing simulator, especially when using virtual reality glasses, they should immediately stop and notify an employee of the SimRacing Garage .
RESPONSIBLE BEHAVIOR 4.1. Competitors are obliged to observe the norms of sportsmanship: 4.1.1. Rude or inappropriate language, shouting or swearing, as well as disrespectful or aggressive behavior towards officials, other competitors or the equipment will not be tolerated. 4.1.2. The presence of intoxicated Competitors under the influence of alcohol, drugs or other substances is not tolerated. 4.1.3. It is absolutely forbidden to push, kick or exert any kind of force on the racing simulators. 4.2. SimRacing Garage issues a warning to a competitor who violates the norms of sportsmanship. In case of a repeated or continuing violation, the competitor will be removed from the racing simulator and from the hall. In this case, the remaining duration of the prepaid package is not compensated. 4.3. Simracing Garage has the right to refuse to admit a Competitor to the hall or to use the racing simulators, if the Competitor is in an intoxicated state, violates the norms of sportsmanship or has previously violated them.
LIABILITY 5.1. A competitor who, due to improper use, has caused damage or damage to the racing simulators or the rest of the equipment, owes Simracing Garage compensation for damages suffered and lost profits. If the Contestant has provided a deposit, it may be used to cover the compensation owed. If necessary, SimRacing Garage can seek its rights in court. 5.2. Competitors use the racing simulators at their own risk. By fulfilling its obligation to conduct instruction on correct and safe use, Simracing Garage is released from responsibility for direct or indirect damages or injuries suffered by the Competitors as a result of using the racing simulators. 5.3. Simracing Garage is not responsible for the Competitors’ belongings, including if they are stolen or damaged while using the racing simulators.
PERSONAL DATA PROTECTION POLICY 6.1. Simracing Garage collects personal data during the registration of user profiles of Competitors with a view to establishing contractual relations, making contact and for marketing purposes. 6.2. Video surveillance is carried out on the territory of the hall to ensure the safety of the Competitors and the equipment. 6.3. Simracing Garage collects, stores and processes personal data in accordance with the Personal Data Protection Policy , which you should familiarize yourself with.
ELECTRONIC BULLETIN (NEWSLETTER) 7.1. Simracing Garage has the right to send to the Competitors who have registered for the service, an electronic newsletter containing information about current blog posts, promotions and offers related to the company’s activities.
WEBSITE. PAYMENT THROUGH A VIRTUAL POS TERMINAL 8.1. The website of Simracing Garage – simgarage.bg – presents the company’s activities, provides informative content and a thematic blog with publications, offers the opportunity to: 8.1.1. registering a user profile; 8.1.2. booking hours to use racing simulators; 8.1.3. purchase of packages for use of racing simulators; 8.1.4. subscribing to an electronic bulletin (newsletter). 8.2. Contestants register a user profile on the website to access all functionalities. When registering a user profile, a unique username and password are set and three names, a current phone number and an email are provided. 8.3. The competitor receives a confirmation of a reservation made through the website. 8.4. All prices on the website are in Bulgarian leva. Payment is made by the Contestant on the spot in the hall or on the website from a registered user profile with a debit or credit card. 8.5. Payment on the website with a debit or credit card is made through a virtual POS terminal of an external payment service provider. The entrant may be bound by the terms and conditions and/or fees of the payment service provider. Simracing Garage does not collect or store data about the bank cards used for payment on the website. 8.6. The competitor who purchased packages for the use of racing simulators on the website with a debit or credit card has the right to withdraw from the contract without giving a reason and without paying compensation or penalty within 14 days from the date of purchase of the packages and only if they have not already been used. In order to exercise the right of withdrawal, the Contestant must unequivocally notify SimRacing Garage of their decision to withdraw from the contract, by individualizing the packages, the use of which is refused. Amounts paid by the Contestant are refunded to the debit or credit card with which the packages were purchased. 8.7. The web site simgarage.bg and all its content are objects of intellectual property, protected under the current Bulgarian and applicable international legislation. Simracing Garage owns the intellectual property rights to the website in its entirety, as well as to all of its individual components components (including logos, brands, photos, videos, texts, drawings, graphics, presentations, etc.), and its content may not be used by third parties without the express written consent of the copyright holder.
